This privacy notice ("Privacy Notice") explains how we at Momently, Inc. ("Momently", "we", or "us") collect, use and share our users ("you" and "your") personal information ("Personal Information"). Please read the following to learn about our privacy notice and the types of information we gather.

By visiting the www.momently.com website and domain name, any other linked pages, features, content, mobile applications, and any other services we offer in connection with any of the foregoing (collectively, the "Site"), along with services related to the Site (collectively, the "Service"), you agree to the practices and policies set forth in this Privacy Notice, and you hereby acknowledge and consent to our collection, use, and sharing of your information as described in this Privacy Notice. Please note that this privacy notice does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage, even if you have accessed the websites or services of those companies through our Website. If you submit personal information to any of those sites, your information is governed by their privacy notice. We encourage you to carefully read the privacy notice of any site you visit.

  1. What Personal Information do we collect?

    Users of Websites on which the Service are Implemented.

    For end users of Customer Websites, when an end user visits a Customer Website, We collect certain information regarding their use of the Customer Website, such as their IP address and browser type. Their session on the Customer Website will be tracked, but each user will remain anonymous. We may use their IP address to identify the general geographic area from which they are accessing the Customer Website. We do not link IP addresses to any personal information. We also use this information for systems administration purposes, abuse prevention and to track user trends.

    We collect information relating to traffic ("Traffic Data") on a website on which the Service is implemented (“Customer Website”). In connection with the collection of this Traffic Data, we do not collect any personally identifiable information from users of Customer Websites, provided that (i) Momently does collect IP addresses from visitors to Customer Websites in order to show geolocation information, and (ii) the Customer configures the Momently Code on the Customer Website in accordance with the instructions and documentation provided by us, so that URLs containing personally identifiable information of end users are not captured by the Service. User sessions of Customer Websites will be tracked, but each user will remain anonymous. We also collect and use browser header information to help Us understand from which websites a user navigates to a Customer Website.

    Traffic Data is used to provide Customers with real-time analytics. We may aggregate and anonymize Traffic Data with that from other sites to provide benchmarking data and other functionality, but Momently will not use or disclose aggregated Traffic Data in a manner that reveals the identity of a Customer or Customer Website without the Customer’s express prior consent.

    Momently is not and shall not be liable for any collection or use of personally identifiable information of end users of a Customer Website due to a Customer’s placement of the Momently Code on the Customer Website not in accordance with Momently’s instructions or the documentation.

    Users of Our Service.

    We collect and store Personal Information of users of Our Service ("Customers") when they register to our Site, subscribe, create an account, or otherwise interact with our Site. Information such as your name and email address to allow Us to identify Customers, provide the Service and notify Customers of changes or updates to the Service. We may also collect information you supply to us regarding your personal preferences and interest. If you choose not to provide us with any or all of the information we specify or request, you may not be able to register with us or to take advantage of some or all of our services.

    We also collect other information such as IP address and browser type. We use the IP addresses of Customers to assist in login and other uses related to Customers’ use of the Service. Your sessions on Our Site are also tracked for systems administration purposes and to track user trends. We may link IP address and other information to a Customer's account.

  2. How we collect personal information?

    Personal Information Collected automatically

    We use cookies, browser analysis tools, and web server logs on Customer Websites to automatically collect certain information which helps Us understand how users interact with those Customer Websites. Cookies are bits of data assigned by a web server that uniquely identifies the browser on your PC and helps us analyze user behavior throughout the Customer Websites. They can also help in detecting certain kinds of fraud and making the Internet experience quicker and more convenient. You have the option of limiting or disabling cookies, but doing so may prevent you from accessing or using the Service.

    The type of information we collect from cookies can vary. For example, we may collect information from the devices you use to access our Customer Websites, your operating system type, browser type, domain, and other system settings, as well as the country and time zone of your device. Browsers routinely send these types of information to web servers. Our server logs also record the Internet Protocol (“IP”) addresses of the devices you use to interact with the Customer Websites to identify potential hackers. An IP address is a unique identifier that devices use to identify and communicate with each other on the Internet.

    In addition, we use cookies in connection with third party services to run analytics on Our Site. This information is collected in non-identifiable ways without any reference to Personal Information. And it is primarily used to optimize our Site and understand its traffic and usage patterns. The use of cookies by our partners, affiliates, tracking utility company, service providers is not covered by our privacy notice. We do not have access or control over these cookies.

    Personal Information You Provide Us

    We collect and store your Personal Information when you register to our Site, subscribe, create an account, or otherwise interact with our Site.

    We may also track the pages and contents you view, like, and follow as well as the comments/reviews you make to the forums, bulletin boards, discussion groups, chat rooms or other methods of communication that may be offered on or through the Site from time to time (collectively “Communities”), or to those related to our social media pages or accounts. We also collect Personal Information if you contact us via telephone, email, text, postal mail, social media interaction, or other methods of communication, such as for customer support purposes.

    If you use a social media platform or your mobile device (or other method of communication) to interact with Momently, the application may have a specific privacy notice that governs the use of Personal Information related to that application. For example, if you use a Momently mobile application and your mobile device’s settings allow it, we may collect Mobile Location Information from your device. Our application may be designed to collect information even if you are not logged into the Momently application.

  3. How we use personal information?

    We may use Personal Information we obtain from users of our Site, Customers of our Service, and end users of our Customer Websites as follows:

    • Determine which websites originated traffic into Customer Websites implementing the service

    • Provide customers with content analytics. We may also aggregate Traffic Data from Customer Websites to provide benchmarking data and other functionality. We will never use or disclose the aggregated Traffic Data in a manner that reveals the identity of a Customer or Customer Website without the Customer’s express prior consent.

    • Register users at our website, and manage and maintain their account on the Site

    • Enable users to log in and use the Service with their user ID and password information.

    • Communicate and provide additional information that may be of interest to you about our products, services, offers, events and promotions.

    • Fulfill our legal obligations and comply with applicable legal requirements, industry standards and our policies.

    We also collect information through cookies and other automated means to identify and authenticate visitors.

    In addition we use the information we collect to personalize your experience with us, to update you on featured trends and products, services and events that may be of interest to you, for promotional and other purposes described in this section. Please note that we provide specific notice at the time of collection if we were to use personal information in any other ways.

  4. Purchase Information

    If you purchase subscriptions to our Service from our Site, we request that you provide your name, email address, credit card information, and other information necessary to open your account and complete the transaction. We do not collect or store your full credit card information (although we may store the last four digits for verification purposes). Our credit card processing service provider will collect and store full payment card information from you to pay for your Service.

    We do not sell or otherwise rent your Personal Information in personally identifiable form to anyone. We share you personal information only as described in this Privacy Notice.

    Affiliated Companies, Business Partners, and other Third Parties

    We may share certain personal information with our affiliated companies, business partners, and other third parties in certain situations such as communicating with you about products and services, offers, events and promotions. Please note that we only share Personal Information to the extent that we deem it related to the services provided by our partners. We may also disclose non-personally identifiable information with our partners in the form of reports that contain aggregated and statistical data about our users. With your prior consent, we may share your personal information with any other third party.

    Service Providers

    We may need to share certain Personal Information with our service providers who perform tasks on our behalf and need your information to provide products or personalized services to you. Our service providers do not have any right to use your Personal Information except as necessary to perform tasks on our behalf. They are not authorized to disclose your Personal Information unless we inform you otherwise.

    Traffic Data

    We may aggregate user Traffic Data from Customer’s Websites to provide benchmarking data and other functionality, but we will not disclose aggregated Traffic Data in a manner that reveals the identity of a Customer or a Customer Website without the Customer’s express prior consent. Except as set forth in this Privacy Notice, you will have certain choices about what information we collect, how we use and share the information, and how we communicate with you. You also have the option of withdrawing your consent or objecting on legitimate grounds to the course of Personal Information handling. Please note that if you choose to withdraw your consent to Momently’s use or disclosure of your information, your ability to use our Site and services will be limited.

    User/Employee Safety

    We may release Personal Information about you when we believe that release is necessary or appropriate to protect our rights, prevent physical harm or financial loss to our employees, our users, or others. We also may disclose information if we are required to do so in response to a request as required by law, such as complying with a subpoena, or similar legal process, for fraud protection or other suspected or actual illegal activities.

    Sale or Transfer of Business

    We reserve the right to transfer user information (which may include your Personal Information) as part of the business assets in the event we sell, merge or transfer all or portion of our business. In such an event, you may contact the third party with the acquired assets to inquire about processing Personal Information and related policies.

    Except as set forth in this Privacy Notice, you will have certain choices about what information we collect, how we use and share the information, and how we communicate with you. You also have the option of withdrawing your consent or objecting on legitimate grounds to the course of Personal Information handling. Please note that if you choose to withdraw your consent to Momently’s use or disclosure of your information, your ability to use our Site and services will be limited.

    Business Partners

    Please email us at legal@momently.com if you do not want us to share your Personal Information with our business partners. Otherwise we will continue to share your information with our service providers to fulfill your requests and to comply with legal requirements.

    Marketing Emails

    If you do not wish to receive marketing emails from us, you can either change your account settings by adjusting your email preferences or click on unsubscribe link in the email.

    Cookies

    You may choose to stop accepting new cookies, adjust your browser settings to be notified when receiving new cookies, or disable existing cookies. Please note, however, that without cookies you will not be able to take full advantage of all of our sites’ features.

  7. How we keep personal information secure?

    We have implemented an information security program that contains administrative, technical and physical safeguards designed to reasonably protect the Personal Information we collect against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use.

    Although we have taken all the necessary measures to safeguard sensitive information when it is being transmitted over the Internet, no electronic transmission of information can be entirely secure. Therefore we cannot guarantee that our security measures will always be sufficient or effective, or that those measures will never be defeated or fail. You can further protect yourself by safeguarding your Momently account by not sharing your user name and password information with anyone. It is also safe practice to sign out of your account and close your browser window when you have finished your visit to our Site. Also keep in mind that we never ask for your Momently account user name and password via email.

  8. How you can access and correct personal information?

    You can access, update and delete your Personal Information, and the other information you provided to use in your account settings by logging into your account and accessing the "Settings" section of the Site or sending us an email at conatct@momently.com. Please note that keeping your Personal Information current helps ensure that we offer you the latest and upcoming sales.

    You can contact us at legal@momently.com, if you want to close your account or have other questions or requests regarding your account. While we are ready to assist you in managing your subscriptions and/or closing your account we cannot always delete records of past interactions for compliance reasons. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

    We will retain your information for as long as your account is active or as needed to provide you services. Please contact us if you wish to cancel your account or request that we no longer use your information to provide you services.   9. Social connect

    We offer Facebook, Twitter and Google users the option to register with Momently using their Facebook, Twitter, or Google account. If you are already logged into Facebook, Twitter, or Google, we will ask you to grant Momently permission to access your Facebook, Twitter, or Google account’s basic information such as first and last name and also your email address. Upon granting access to your email address, Momently will create an account with your basic information, which you can use to setup analytics for your website. Momently does not access your Facebook or Twitter feeds, and does not send messages to your friends list or send any message on your behalf.

  10. Modification and notification of changes to this privacy notice

    We may update this Privacy Notice periodically and without prior notice to you to clarify our practices or to reflect new or different privacy practices, such as when we add new features to our Site. If we make any material changes to our Privacy Notice we will notify you by posting a prominent notice on our Site prior to the change becoming effective. We encourage you to periodically review this page for the latest information about our privacy practices. It is indicated at the bottom of this Privacy Notice when it was most recently updated.
